Terms of Service

Please read these Terms of Service carefully before using the services provided by Next Phase Heating and Cooling. By engaging our services, you agree to be bound by these terms.

By accessing or using the website located at nextphaseheating.com, scheduling an appointment, requesting a quote, or engaging any of the services offered by Next Phase Heating and Cooling ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

If you do not agree with any part of these terms, you must refrain from using our website and services. These Terms of Service constitute a legally binding agreement between you and Next Phase Heating and Cooling. We recommend you print or save a copy of these terms for your records.

You represent and warrant that you are at least 18 years of age and have the legal authority to enter into this agreement. If you are scheduling services on behalf of another person or entity (such as a property management company or homeowners association), you represent that you have the authority to bind that person or entity to these terms.

2. Services Description

Next Phase Heating and Cooling provides professional heating, ventilation, and air conditioning (HVAC) services to residential and commercial customers in Covington, WA 98042 and the surrounding service area. Our services include, but are not limited to:

  • Heating Services: Furnace repair, installation, and maintenance; boiler services; radiant heating systems; and comprehensive heating system diagnostics.
  • Cooling Services: Air conditioning repair, installation, and maintenance; central air systems; ductless mini-split systems; and evaporative cooling solutions.
  • Heat Pump Services: Heat pump installation, repair, and maintenance; air-source and ductless heat pump systems; seasonal tune-ups and efficiency optimization.
  • Installation: New HVAC system design and installation; equipment upgrades and replacements; ductwork installation and modification; thermostat and smart home integration.
  • Maintenance: Preventive maintenance agreements; seasonal tune-ups; filter replacement programs; system performance inspections and indoor air quality assessments.
  • Emergency Services: 24/7 emergency repair services for urgent HVAC failures, including heating system breakdowns during winter months and cooling system emergencies during summer.

The scope of work for each project or service call will be discussed and agreed upon before work begins. We reserve the right to decline service requests that fall outside our area of expertise, service territory, or that we determine may pose safety risks.

3. Scheduling & Appointments

Appointments may be scheduled by calling us at (425) 648-7887, emailing [email protected], or through the contact form on our website. When scheduling, please provide:

  • Your full name and contact information
  • Service address and any special access instructions
  • A description of the issue or service needed
  • Your preferred date and time window
  • Any relevant equipment details (brand, model, age of system)

Appointment Windows

We schedule appointments within arrival windows to account for the variable nature of HVAC service calls. Our technicians will contact you when they are on their way to your location. While we make every effort to arrive within the scheduled window, delays may occasionally occur due to prior service calls taking longer than anticipated, traffic, weather conditions, or unforeseen circumstances.

Customer Responsibilities

You agree to ensure safe and reasonable access to the HVAC equipment and work areas at the scheduled time. An adult (18 years or older) must be present at the property during the entire service visit. If our technician arrives and is unable to access the property or the equipment, a trip charge may apply. You are also responsible for clearing the area around your indoor and outdoor HVAC units to allow our technicians safe working conditions.

4. Pricing & Payment

Estimates & Quotes

We provide written estimates for all services before work begins. Estimates are based on the information available at the time of assessment and are valid for 30 days unless otherwise stated. Actual costs may vary if additional issues are discovered during the service process; in such cases, we will obtain your approval before proceeding with any additional work that exceeds the original estimate.

Payment Terms

Payment is due upon completion of service unless other arrangements have been made in writing. We accept the following payment methods:

  • Major credit and debit cards (Visa, Mastercard, American Express, Discover)
  • Checks (personal or business)
  • Cash
  • Financing options (subject to credit approval through our financing partners)

Late Payments

Invoices not paid within 30 days of the service date may be subject to a late fee of 1.5% per month (18% annually) on the outstanding balance. We reserve the right to suspend future services for accounts with outstanding balances and to pursue collection of unpaid amounts through appropriate legal channels. The customer shall be responsible for all reasonable collection costs, including attorney fees, incurred by us in collecting past-due amounts.

5. Warranties & Guarantees

Workmanship Warranty

Next Phase Heating and Cooling stands behind the quality of our work. We provide a workmanship warranty on all labor performed by our licensed technicians. If a problem arises that is directly attributable to our workmanship within the warranty period, we will return to correct the issue at no additional charge. The duration and specific terms of the workmanship warranty will be provided in writing as part of your service agreement or invoice.

Equipment Warranties

HVAC equipment installed by Next Phase Heating and Cooling is covered by the manufacturer's warranty as specified by the equipment manufacturer. We will assist you in registering your equipment for warranty coverage and will process warranty claims on your behalf whenever possible. Manufacturer warranties are separate from our workmanship warranty and are subject to the manufacturer's terms and conditions.

Warranty Exclusions

Warranties do not cover damage caused by misuse, neglect, failure to perform recommended maintenance, unauthorized modifications, acts of nature (including power surges, lightning strikes, flooding, or earthquakes), or pre-existing conditions not identified during the initial service assessment. Regular maintenance through our service plans is strongly recommended to maintain warranty coverage and extend the life of your HVAC systems.

Satisfaction Guarantee

Your satisfaction is our priority. If you are not completely satisfied with our service, please contact us within 48 hours and we will work with you to resolve the issue promptly and professionally.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Next Phase Heating and Cooling, including its owners, employees, contractors, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services or website
  • Any unauthorized access to or alteration of your personal information
  • Delays in service delivery caused by factors beyond our reasonable control, including severe weather, supply chain disruptions, equipment backorders, or pandemic-related restrictions
  • Recommendations or advice provided by our technicians regarding your HVAC system
  • The performance, malfunction, or failure of third-party equipment not installed by our company

In no event shall our total cumulative liability to you for all claims arising from or related to our services exceed the total amount you paid to Next Phase Heating and Cooling for the specific service giving rise to the claim. This limitation applies regardless of the legal theory under which liability is asserted, whether in contract, tort, strict liability, or otherwise.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these terms shall limit our liability for gross negligence, willful misconduct, or any liability that cannot be excluded by law.

7. Cancellation Policy

Standard Service Appointments

We understand that plans change. You may cancel or reschedule a standard service appointment at no charge by providing at least 24 hours' notice prior to your scheduled appointment time. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee to cover the cost of the reserved time slot and dispatched resources.

Installation Projects

For installation or large-scale projects, cancellation terms will be outlined in your individual service agreement. Generally, cancellations made after equipment has been ordered on your behalf may be subject to restocking fees charged by the manufacturer or distributor. Cancellations made after work has commenced will be billed for all labor and materials expended up to the point of cancellation.

Maintenance Agreements

Maintenance agreements may be cancelled at any time with 30 days' written notice. If you cancel a prepaid maintenance agreement before all scheduled visits have been completed, we will refund the prorated unused portion minus any discount you received by purchasing the agreement. No refunds will be issued for services already rendered.

8. Intellectual Property

All content on the Next Phase Heating and Cooling website, including but not limited to text, graphics, logos, images, photographs, icons, videos, audio clips, data compilations, page layouts, and software, is the property of Next Phase Heating and Cooling or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

The "Next Phase Heating and Cooling" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Next Phase Heating and Cooling. You may not use these marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this website are the trademarks of their respective owners.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from our website without our express written consent, except for temporary copies automatically created by your web browser for display purposes, or for personal, non-commercial use only.

9. Governing Law

These Terms of Service, and any disputes arising from or relating to these terms or our services, shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms of Service shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts. You agree to waive any objection to the exercise of jurisdiction over you by such courts and to the venue of such courts.

Next Phase Heating and Cooling is licensed and operates in compliance with all applicable Washington State laws and regulations governing HVAC contractors, including requirements set forth by the Washington State Department of Labor & Industries. Our services are performed by trained, certified, and licensed professionals.

Dispute Resolution

In the event of a dispute, we encourage you to first contact us directly to seek an informal resolution. If we are unable to resolve the matter informally, both parties agree to attempt mediation before pursuing litigation. The cost of mediation shall be shared equally between the parties. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for matters related to data security, intellectual property, or any other claims where equitable relief may be appropriate.

10. Changes to These Terms

Next Phase Heating and Cooling reserves the right to revise and update these Terms of Service at any time at our sole discretion. All changes are effective immediately when posted on this page and apply to all access to and use of the website and services thereafter.

When we make material changes to these terms, we will update the "Last Updated" date at the top of this page. We may also make reasonable efforts to notify you of significant changes, such as by posting a notice on our website homepage or sending a notification to the email address we have on file for you.

Your continued use of our website or services following the posting of revised Terms of Service constitutes your acceptance of and agreement to the changes.
